Terms and Conditions of Sale
The Lindisfarne Limited (LL) website provides customer sales on behalf of the operating businesses of the Harry Hotspur Holdings (HHH) group of entities.
These terms and conditions are in respect of the group’s website sales through the following HHH group companies, namely, Lindisfarne Limited (‘LL’), The Alnwick Brewery Limited (‘ABC’) and The Alnwick Rum & Spirit Company Limited (‘AR&SC’). Any reference within these terms and conditions to the HHH group companies refers to the online sales made by LL, ABC and/or AR&SC through this channel.
The sales of any goods by the HHH group companies shall be subject to the following terms and conditions. Nothing in these terms shall affect a customer’s statutory rights as a consumer.
The HHH group companies supply goods primarily to the UK at this moment in time.
The HHH group companies reserve the right to contact customers and offer them the product they are attempting to buy at the true price should an error occur in their online shopping system. Our online store provides an invitation to treat, and the HHH group companies reserve the right to refuse an order.
Confirmation of Orders
Once an order is received, the HHH group companies will confirm the acceptance of the order by an e-mail to the customer using the e-mail address provided on the order form. The HHH group companies’ acceptance of an order brings into existence a legally binding contract (“the Contract”).
Delivery of Goods
Delivery of the goods will be affected as soon as practically possible after an order has been accepted. Where it is impossible to deliver within 30 days of the order, the customer will be informed of this fact and given the option of cancelling the order. Delivery will be to the address provided on the order form.
Availability of Goods
Where goods ordered are unavailable the customer will be notified of that fact and any sums paid will be refunded. In these circumstances the HHH group companies will not be obliged to offer any additional compensation for any inconvenience or disappointment suffered.
Liability
Nothing in these terms and conditions of sale shall limit or exclude any of the HHH group companies’ liability for:
(a) Death or personal injury caused by its negligence, or the negligence of its employees, agents or subcontractors;
(b) Fraud or fraudulent misrepresentation; or
(c) Breach of the terms implied by section 2 of the Supply of Goods and Services Act 1982 (title and quiet possession) or any other liability which cannot be limited or excluded by applicable law; or
(d) Defective products under the Consumer Protection Act 1987.
Subject to the above, none of the HHH group companies shall be liable to the customer, whether in contract, tort (including negligence), for breach of statutory duty, or otherwise, arising under or in connection with the Contract for:
(a) Loss of profits;
(b) Loss of sales or business;
(c) Loss of agreements or contracts;
(e) Loss of use or corruption of software, data or information;
(f) Loss of or damage to goodwill; or
(g) Any indirect or consequential loss.
The HHH group companies’ total liability to the customer in respect of all other losses arising under or in connection with the Contract, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the price of the goods.
The HHH group are not, however, responsible for the actions of the couriers used to deliver products to end customers.
Cancellation and refund policy
A customer may withdraw/cancel an order at any time up to the end of the fourteenth day after receipt of the goods. A withdrawal/cancellation of an order must be notified either by e-mail or in writing followed by the return of the good(s) (where applicable). Such notification must be received within fourteen days of the customer receiving the goods. A customer does not need to give the HHH group of companies any reason for withdrawing the order.
Items may only be returned if the seal remains unbroken and the goods are in the original condition. The customer must supply an order confirmation number in order to receive a refund and must return the goods to St Aidan’s Winery, The Holy Island of Lindisfarne, Northumberland, England TD15 2RX within 14 days of receiving the order. Where orders are cancelled and goods have already been dispatched, the HHH group of companies will refund the cost of the goods less delivery postage.
Jurisdiction and Governing Law
Any sales contract entered into by the HHH group companies will be governed by and interpreted only in accordance with English law and the English courts shall have exclusive jurisdiction to resolve any dispute between the parties.
Special Offers
From time to time the HHH group companies may create special offers, discounts or other promotional inducements. Such offers will be for limited periods and are only available in respect of transactions made on our online sales system. Such offers are not available to customers in any of our shops unless expressly stated otherwise. Discounts cannot be used in conjunction with existing offers / discounts.
Entire Agreement
These terms and conditions of sale together with the order confirmation shall form the whole agreement relating to the sale of goods by the HHH group companies.
Third party rights
Unless expressly stated otherwise, the Contract does not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of the Contract.

Harry Hotspur Holdings Limited (“HHH”) from time to time offer customers Thank You Cards at their point of purchasing a product. The following terms and conditions apply to any customer being handed one of these.
1 The Thank You Card (‘TYC”) can only be used by the person, i.e. the Approved User who has spent in excess of the following levels at one of our Approved Outlets
2 Approved Outlets; Lindisfarne Limited’s shop on Holy Island, The Alnwick Rum Shop’s outlet A Taste of Northumbria (ATON) in Alnwick and at external events where HHH may have a presence.
3 Customers who buy goods in excess of the following thresholds are entitled to a TYC should a stock of them be available at the time of the transaction.

* This is dependent on which company is leading the event i.e. Lindisfarne Limited or Alnwick Rum lead. This will be made clear to the customer at the time of the transaction.
4 The Approved User will at the time of receiving the TYC be informed of the discount being offered and the period over which it is available (which will be noted on the card). The discount & period of availability for use will vary depending on the time of year the Approved User makes his or her purchase.
e.g. If the card is being issued for use for say 2 months then for clarity this would mean the month of the transaction plus 1 more month. So a purchase on 13 March on a 2-month card would allow purchases to be made up to and including the 30 April.
A card that is offered for issue for say 3 months would be the month of the transaction plus 2 more months.
5 The card cannot be given to another person by the Approved User for their use.
6 The card invites the Approved User to receive discount on all products shown in our group web site and at the sales price as shown.
7 The card does not entitle anyone to receive discount on any product or group of products that is/are already being shown at an offer price on our web site e.g. 2 for the price of £xx. Etc.
8 The TYC does not entitle the Approved User to receive any discount on any future purchase(s) he or she may make at any of our shops or external events.
9 The discount given to an Approved User is calculated based on the disclosed selling price on our web site at the time of the buying transaction and not by reference to any price seen in one of our shops or external events.
10 If products are out of stock and a sales transaction cannot be completed by the end of the final day that the card is active then no discount will be available to the Approved User.
11 The Approved User, in using the TYC for any purchase of products on our group website, fully agrees with and complies with all our terms and conditions noted here.
Bulk/Wholesale offers on our Website
From time to time we offer a range of our group products that are made available for sale on a bulk basis (i.e., beers in casks, meads and rums in 25 to 1,000 litre containers).
Any customer wishing to enquire over the availability of such lines and their prices must complete the drop-down enquiry email on our web site. We will then enter correspondence with the potential customer over prices and availability for the specific enquiry.
Any such sale will be subject to our normal customer vetting processes and, at least, the first sale will be processed on a proforma invoicing basis.
